Terms of Use Customercard

1. The Lovers' Card is valid in all the businesses of Marché International. The account is managed in the relevant currency of the country issuing the Lovers' Card.

2. The Lovers' Card is not personal and is transferable. Interest is not earned on any balance. The Lovers' Card remains valid for three years after it was last used. The balance on the Lovers' Card can be used to make payments in full or in part.

3. The Lovers' Card is to be treated like cash. In the event of loss, theft or damage, only registered Lovers' Cards can be replaced. No liability is assumed in the event of loss or theft. Claims may be asserted only on presentation of the Lovers' Card.

4. If a contract is concluded regarding the purchase of the Lovers' Card exclusively using means of telecommunication, insofar as the purchaser is the consumer, the following provisions apply:

   1. An order by a customer represents a binding offer for the conclusion of a purchase agreement. Acceptance of this offer is carried out either through an express declaration of acceptance in writing or by e-mail no later than with the handing over or dispatch of the Lovers' Card.

   2. Right of cancellation

      You may cancel your contract declaration within two weeks without stating any reason in writing (e.g. letter, fax, e-mail) or if you have been handed the Customer Lovers' Card before this period expires – by sending the Customer Lovers' Card back. The period begins on receipt of this information in writing, however, not before receipt of the goods by the recipient. For the cancellation period to be valid, the cancellation or the Customer Lovers' Card must be dispatched promptly. The cancellation is to be sent to: Marché Restaurants Deutschland GmbH, Esslinger Str. 7, 70771 Leinfelden-Echterdingen, e-mail customerservice@marche-int.com.

   3. Consequences of cancellation

      In the event of an effective cancellation, the services received on both sides are to be returned. If you are not able to return the service received in full or in part or only in a damaged condition, you might have to compensate for the loss in value to this extent.

5. Marché International is responsible only for intent and gross negligence. Apart from personal injury, bodily harm or damage to health and also infringing obligations, which must be satisfied to make the correct implementation of the contract possible and which the customer must normally rely on to be satisfied.

6. The Customer Lovers' Card which has been ordered will be supplied and dispatched by post. Marché International accepts no responsibility for the time of receipt by the customer.

7. Insofar as the purchaser is a company, all the shipments, including any return shipments, will be borne by the customer.

8. The card expires after 36 months if not used over this period of time.

9. The Customer Lovers' CardLovers' Card remains the property of Marché International until the complete satisfaction of all the liabilities arising from this contractual relationship. The customer is obliged to notify Marché International of access by a third party to the Lovers' Cards supplied under reservation of ownership immediately by sending the documentation justifying intervention.

10. Marché International points out that the customer data collected in connection with the contract to satisfy the contractual relationship will be processed in accordance with the current valid data protection regulations. The data will be used only for the purpose mentioned and will not be passed on to any unauthorised third parties. Marché International may allow data to be processed to provide goal-oriented services from other instructed and carefully selected partner companies.

11. If a provision is or becomes ineffective, the remaining provisions will remain valid.
